Why International Law Still Falls Short on Equal Parenting Rights

Existing labor protections around the world continue to reinforce gender inequality by assigning the primary responsibility for caregiving to mothers. Despite decades of advocacy for shared parenting, international legal frameworks remain stubbornly anchored in outdated assumptions about family roles.

Current maternity leave policies, while well-intentioned, often entrench the idea that mothers are the default caregivers. Paternity leave, where it exists at all, is typically shorter, less generous, or entirely optional. This imbalance sends a clear message: childcare is women's work. The result is that women face career penalties, wage gaps, and reduced opportunities, while men are discouraged from taking an active role in early parenting.

International law has been slow to adapt. Treaties and conventions from the International Labour Organization and other bodies focus heavily on protecting mothers, but rarely mandate equal or shared leave for fathers. The language of "protection" for women, originally meant to shield them from exploitation, now often locks them into caregiving roles. Without binding standards for paid, non-transferable parental leave for both parents, the system perpetuates the very inequality it claims to address.

Some countries have experimented with "use it or lose it" leave for fathers, which shows promise in shifting norms. But without a global push to redefine caregiving as a shared responsibility, the legal foundation for equal parenting remains weak. Until international law treats both parents as equally responsible for care, gender equality at work and at home will remain out of reach.
